TITLE: Occupant Relationships

OCCUPANT is defined as either a resident or a tenant.

RESIDENT is defined as any person paying Evergreen Estates rent and is receiving Assisted Living services. These persons will always be considered vulnerable adults regardless of their functional mental or physical capacities.

TENANT is defined as any person paying Evergreen Estates rent and is not receiving Assisted Living services.

Violation of any part of this policy will result in disciplinary action, up to and including termination.

Employees are required to inform the Administrator in advance and in writing of an intimate relationship with an occupant prior to the person moving into the facility. An intimate relationship is defined as any sexual, romantic, dating, or other similar relationship. Failure to notify the Administrator prior to the occupant moving in will be deemed to mean the relationship started after the occupant moved in and will be classified as inappropriate.

An employee will be terminated and an investigation will be started upon the Administrator learning of an inappropriate relationship with a RESIDENT. Appropriate law enforcement, state protective agencies, responsible parties, state case worker and physician will be informed, as needed.

A reported relationship between an employee and TENANT that was not reported to the Administrator upon the tenant moving in will be investigated. The employee will be suspended during this investigation and may be disciplined for failing to report a pre-existing relationship, up to and including termination of employment. During this investigation process appropriate law enforcement, state protective agencies and responsible parties may be contacted, as needed.
