TITLE: Standards of Conduct & Disciplinary Actions

The orderly and efficient operation of the facility requires that employees working together abide by basic rules and conduct themselves in a professional manner. Employees are required to maintain high standards of conduct while employed with Evergreen Estates.

The list below is some of the behaviors that Evergreen considers unwanted and that may result in the employee being disciplined or terminated:

• Failure to comply with any policy within this handbook.
• Possession of a firearm or other dangerous weapon within the facility.
• Engaging in or threatening to engage in any violent, intimidating, hostile, or harassing behavior.
• Overall, poor performance of duties that do not meet the expectations of your direct supervisor.
• Refusal to follow lawful instructions of your supervisor.
• Inability to work as a cooperative team member with others.
• Failure to meet one’s Job Description and/or offer letter’s written requirements.

Occupant related issues

• Any form or manifestation of resident abuse or neglect
• Providing care to a resident against the physician’s orders and/or the nurse’s direction, to include correctly and accurately providing medications, treatments or other services as ordered
• Interfering in the overall healthcare of a resident. This includes recommending a physician over another, assisting with hospital or medical institution preference, medication regiments, treatments, procedures and their code status
• Nursing Assistant or cook leaving their work area or premises without proper relief by another similar employee as stipulated in their job description
• Photographing or videotaping of any kind that when taken shows a resident or a resident’s name, without written permission on file in the front office, of a resident or responsible party
• Unauthorized use of resident property
• Taking of a gift or money, without the authorization of the Executive Director. This includes taking items left over from the family after death or move out.
• Failure to obtain and maintain the training, qualifications, certifications or licensure requirements as detailed in your job description
• Treating occupants or visitors in an unprofessional or unkind manner

Facility Property

• An action by the employee that results in damaging the facility, its equipment and/or resident property
• Unauthorized use of facility property
• Theft or attempted theft. Smoking (including the use of e-cigarettes and vape pens) on Evergreen Estates’ property

Supervisor & employee relations, including unwanted behaviors

• Physically or verbally harming or threatening to harm another person
• Interference with coworkers performing their duties
• Falsification of any forms, records and/or reports
• Falsification of an employee timecard
• Lying to your supervisor or peers for the purpose of obtaining preferential treatment or in hiding mistakes that could have hurt others
• Not using Personal Protection Equipment when required or following our policy concerning its usage
• A safety violation that places the employee or co-workers at risk of permanent disability or death
• Sleeping or giving the appearance of sleeping
• Referring disparagingly about the facility, one’s supervisor, peers, residents or visitors orally, in writing or on any social network to include, Facebook, Twitter, Snapchat, Instagram, e-mails and text messages, where such comments could result in embarrassing individual(s) or casting the facility in a negative light
• Allowing debt collectors to contact or harass you at work, your supervisor, or the front office to collect a debt. This includes receiving continued telephone calls to reach you.
• Violation of the Personal Cell Phone and Other Personal Electronic Devices Policy or the Facility-Owned Electronic Devices and Services Policy.
• Excessive personal phone calls during working hours
• Domestic & personal issues that interfere with your or your peers’ work performance
• Gambling of any kind on company property
• Soliciting for any cause during the employee’s assigned working time or soliciting other employees for any cause during their assigned working time. “Working time” is the time an employee is engaged in or should be engaged in performing work duties for Evergreen Estates.
• Distributing or posting literature for any purpose in work areas or during the employee’s assigned working hours without the prior approval of the Administrator
• Disorderly conduct that is contradictory to acceptable professional behavior

PROGRESSIVE DISCIPLINARY ACTION

Scope and/or severity of the actions of an employee may differ from one situation to another and
Evergreen Estates retains the right to administer discipline in any manner it deems appropriate and necessary to ensure a safe and friendly working and living environment for all
